Section 1: Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and Dane Dykman, doing business as Next Lever, located in Ogden, Utah, United States. By accessing or using our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use our services.

Section 2: Description of Services

Next Lever is a business automation audit tool. You submit a short intake form describing your business, current tools, pain points, and goals. We generate a personalized interactive report showing ranked automation opportunities, estimated return on investment ranges, and a phased implementation roadmap. The report is delivered to you via a private link by email.

Section 3: Important Disclaimer Regarding Results

All figures, estimates, ranges, and projections in your report are directional estimates based on your intake answers and industry benchmarks. They are not guarantees of any specific outcome, revenue increase, cost reduction, or business result. Actual results will vary depending on your business, your team, market conditions, implementation quality, and many other factors outside our control. You should consult qualified professionals before making significant business decisions based on this report. Nothing in your report should be construed as financial, legal, operational, or professional advice. You are solely responsible for any decisions you make based on its contents.

Section 4: Payment Terms

Services are provided on a one-time payment basis. The current price is displayed at checkout. We accept Visa, Mastercard, American Express, and Discover, processed securely through Stripe. All payments are in United States dollars. By completing a purchase, you authorize us to charge the displayed amount to your selected payment method.

Section 5: Refund Policy

All sales are final. Because our service involves the generation of a personalized report using computational resources at the time of your submission, we do not offer refunds after your intake form has been submitted and report generation has begun. If you have not yet submitted your intake form after payment, contact us at support@servicesift.com and we will review your request on a case by case basis.

Section 6: Intellectual Property

The report format, software, pipeline, scoring methodology, design, and all content produced by Next Lever are owned by Dane Dykman doing business as Next Lever. You retain ownership of the business information you submitted in your intake form. You are granted a personal, non-transferable license to use your report for your own internal business purposes. You may not resell, redistribute, or republish report content without written permission.

Our services rely on third party providers including Anthropic for report generation, Supabase for data storage, Stripe for payment processing, Vercel for hosting, and Resend for email delivery. Your use of our services is subject to their respective terms and policies. We are not responsible for the availability or conduct of these third party services.

Section 9: Limitation of Liability

To the fullest extent permitted by applicable law, our total liability to you for any claim arising out of or related to these Terms or our services, regardless of the form of the action, is limited to the amount you paid us for the service giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or loss of business opportunity, even if we have been advised of the possibility of such damages.

Section 10: Disclaimer of Warranties

Our services are provided on an as-is and as-available basis without any warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our services will be uninterrupted, error-free, or that any specific result will be achieved.

Section 11: Dispute Resolution

If you have a dispute with us, you agree to first contact us at support@servicesift.com and attempt to resolve the dispute informally. If we cannot resolve the dispute informally within 30 days of your notice, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be resolved by binding arbitration in Utah, United States. You waive any right to a jury trial or to participate in a class action. Any claim not submitted to arbitration within 2 years of the event giving rise to the claim is permanently barred.

Section 12: Governing Law

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles.

We may update these Terms from time to time. When we do, we will update the date at the top of this page and notify you by email if the changes are material. Your continued use of our services after any update constitutes your acceptance of the revised Terms.
